This E-Sign Act Consent (Consent for Use of Electronic Records and Signatures) ("E-Sign Consent") covers the use of electronic records and signatures during your relationship with Prism.  In this E-Sign Consent, the words "you" and "your" mean any individual who is providing consent to our use of electronic records and signatures as described herein.  “Prism,” “we," "us," and "our," mean Prysm Financial Technology Inc. and its affiliates, successors and assigns, and designated third-party service providers acting on our behalf.

Prism offers products and services that include but are not limited to an online consumer loan marketplace through which consumers may apply for and obtain credit products and deposit accounts (“Service” or “Services”).  The delivery, administration, and access to Services may be by electronic means such as through the Internet, a website, email, messaging services (including text messages), or through other software applications that may include applications available on mobile or handheld devices. You understand that we may choose to provide certain records to you in electronic form and that we may obtain your electronic signature in connection with those records and other communications.  If you choose not to agree to this E-Sign Consent, or you withdraw your consent, you may be ineligible to use or obtain our Services.

Description of Electronic Records.

The records covered by this E-Sign Consent include, but are not limited to, all documents, communications, contracts, agreements, terms, statements, notices, authorizations, and disclosures (including federal or state tax documents, statements, forms, and schedules) that arise from or relate to your use or attempted use of any Service.  We reserve the right to decide which records to provide electronically and when to request your electronic signature in connection to those records and Services.

Scope of Your Consent.

This E-Sign Consent applies to all Services that you may use now or obtain in the future. By electronically signing this E-Sign Consent, you agree that you reviewed this E-Sign Consent and that you have verified that you can print or save a copy of it for your records. You give your express consent to receive, view, and electronically sign the records we display on any website, through any web browser, or in any software application (including any application for mobile or handheld devices), and those we may send to your designated email address. You agree that the electronic records we send to your designated email address may include records displayed in the email message, attached to it or displayed when you selected links included in the message. When a record is electronically displayed on your computer or your mobile or handheld device, you agree that your electronic signature for the record may include clicking displayed buttons, selecting displayed boxes, typing your name in a designated field or otherwise selecting an electronic facsimile signature for the field, sending an email reply to a message transmitted to your designated email address, or taking other affirmative actions described when you view an electronic record displayed on your computer or your mobile or handheld device. Your consent for our use of electronic records and signatures will be effective unless you withdraw it in the manner described below.

Obtaining Paper Copies of Records.

If you require paper copies of a record, you may either print the records yourself, or you can write to us at the mailing address provided below and request that we send you a paper copy at a cost of up to $5.00 per requested record.  Your paper copy request will not be considered a request for your withdrawal from this E-Sign Consent.

Hardware and Software Requirements.

In order to access and retain records electronically, you must satisfy the following computer hardware and software requirements:

  • access to the Internet
  • an email account
  • related software capable of receiving email through the Internet
  • supported web browsing software (the most recent version of Google Chrome, Mozilla Firefox, Microsoft Edge, or Apple Safari)
  • software that allows you to view and print or save PDF documents, such as Adobe Reader or similar software
  • hardware capable of running the software described above
  •  a printer or long-term storage device that allows you to print or save electronic records for future reference

Additional Mobile Technology Requirements.

If you are obtaining a Service electronically via a mobile or handheld device (such as a smart phone or tablet), in addition to the above requirements you must have software on your device that allows you to print or save the records. If your device does not have these capabilities, you must use a different device to obtain the Services.

Withdrawing Your Consent.

You may withdraw your consent to receive records electronically by contacting us at the address below. However, once you have withdrawn your consent, you may not be able to request a credit product or deposit account from us, and you may be ineligible to obtain any additional Service or to continue using any current Service. If you withdraw your consent while you have a pending application or other request for a credit product or deposit account, we will terminate your application or request and remove it from our system. If you have already received a closed-end loan from us, all previously agreed to terms and conditions for the loan will remain in effect, and we will send records to your verified home address provided during registration.

Change in Your Contact Information.

You must keep us informed of any change in your email or home mailing address so that you can continue to receive all records in a timely fashion. If your email address changes, please notify us of the change by sending an email to [email protected] or by calling (855) 607-7476. You may also update your home mailing address and telephone number by providing the updated information through your Prism account.

Consent.

By selecting the checkbox and clicking the button displayed in connection with acknowledging and/or agreeing to this E-Sign Consent, you agree that:

  • You have received, read, and agree to the terms of this E-Sign Consent; and
  • You consent to your and our use of electronic records and signatures in connection with any Services that you request, use, or obtain.
